Labor Market Survey (LMS) is a review of employment opportunities in the industrially injured or ill worker´s labor market to obtain specific information (such as physical demands and qualifications) related to existing job postings. It is designed to be a list of jobs that injured worker is qualified for and capable of performing based on their education, training and physical limitations and restrictions.

Labor Market Surveys are a valuable tool for the Claims Handler, especially prepared and presented byour highly trained personnel, who focus on finding adequate job opportunities in a prompt and professional manner.

For Defense Base Act claims, it is recommended that every LMS submitted to the US Department of Labor contain specific types of information. Reports submitted with incorrect or insufficient details will be rejected by the Department of Labor, or any other person or entity charged with oversight of a DBA claim. Everyone in the DBA world has a story where the LMS showing significant earning capacity is gutted by the plaintiff counsel or rejected by the Administrative Law Judge. As the LMS is often used by the Employer/Carrier as proof of alternative employment or retained earning capacity, rejection of the report has a significant (and costly) impact on the overall result of the claim.
